Supreme Court Hears DOMA Case (Full Audio)

Gay marriage was heard before the Supreme Court--listen to the full arguments in the case of United States v. Windsor challenging the Defense of Marriage Act (DOMA)--which prevents same sex couples from receiving the same benefits under the law as a couple consisting of one man and one woman. The basic details of the case: In 2007, Edith "Edie" Windsor and Thea Spyer, residents of New York, married in Toronto, Ontario, after 40 years of romantic partnership. Canada's first openly gay judge, Justice Harvey Brownstone officiated. Windsor had first suggested engagement in 1965. Spyer died in 2009, at which time New York legally recognized same-sex marriages performed in other jurisdictions. After Spyer's death, Windsor was required to pay more than $363,000 in federal estate taxes on her inheritance of her wife's estate. If federal law accorded their marriage the same status as different-sex marriages recognized by their state, she would have paid no taxes. Windsor approached several gay rights organizations, all of whom turned her down. She was then referred to Roberta Kaplan, at the firm of Paul, Weiss, Rifkind, Wharton & Garrison, who had unsuccessfully argued the case challenging the inability of same-sex couples to marry in New York before the New York Court of Appeals in 2006. "When I heard her story, it took me about five seconds, maybe less," said Kaplan, who was joined in Windsor's case by the American Civil Liberties Union (ACLU). Washington was first called "Father of his Country" three years after the beginning of the Revolutionary War – a status he earned not only for his military accomplishments, but also because of the numerous virtues he was perceived to possess as a human being. But within Washington's impeccable character, one quality stood out the most – a unique immunity to the corrupting effects of power, which stemmed from his selfless nature. "I often say of George Washington that he was one of the few in the whole history of the world who was not carried away by power," stated Robert Frost, "America's great poet-philosopher." After overthrowing the tyranny of the British Empire, Americans were unwilling to trust anyone with the power of a central government, yet in George Washington they saw a man who had transcended human fallibility. "Had he lived in the days of idolatry," the Pennsylvania Journal noted in 1777, Washington would have been "worshipped as a god." How could such a man ever abuse his power, let alone become a tyrant? The case Roanoke School Board, et al. v. Harriet B. Kiley was argued on December 1, 1976, at the Ames Moot Court competition. The presiding judges were Hon. John Paul Stevens, Associate Justice, U.S. Supreme Court; Hon. Carl E. McGowan, U.S. Court of Appeals for The District of Columbia Circuit; Hon. Gerhard Alden Gesell, U. S. District Court for The District of Columbia. The Ames Competition, held in the historic Ames Courtroom of Harvard Law School, is one of the most prestigious competitions for appellate brief writing and advocacy in the country. The students participating in the Final Round started the competition in fall of their 2L year.  Two teams progressed to the Final Round through their strong research abilities and excellent written and oral advocacy.

Facts: Betty Dukes, a Wal-Mart "greeter" at a Pittsburg, Calif., store, and five other women filed a class action lawsuit in which they alleged that the company's nationwide policies resulted in lower pay for women than men in comparable positions and longer wait for management promotions than men. The certified class, which in 2001 was estimated to comprise more than 1.5 million women, includes all women employed by Wal-Mart nationwide at any time after December 26, 1998, making this the largest class action lawsuit in U.S. history. Wal-Mart has argued that the court should require employees to file on an individual basis, contending that class actions of this size – formed under Rule 23(b) of the federal rules of civil procedure — are inherently unmanageable and unduly costly. The U.S. Court of Appeals for the Ninth Circuit has three times upheld the class certification. Question: Can the small group of women who began the case represent a gigantic class of women? Conclusion: No. The Supreme Court reversed the lower court order in a unanimous opinion by Justice Antonin Scalia. "Here, proof of commonality necessarily overlaps with respondents' merits contention that Wal-Mart engages in a pattern or practice of discrimination. The crux of a Title VII inquiry is 'the reason for a particular employment decision,' and respondents wish to sue for millions of employment decisions at once," Scalia wrote. "Without some glue holding together the alleged reasons for those decisions, it will be impossible to say that examination of all the class members' claims will produce a common answer to the crucial discrimination question." Justice Ruth Bader Ginsburg concurred in part and dissented in part, joined by Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan. "Whether the class the plaintiffs describe meets the specific requirements of Rule 23(b)(3) is not before the Court, and I would reserve that matter for consideration and decision on remand," Ginsburg wrote. Emerging technologies present the common question of how science can be integrated into the policy debate when, by definition, with an emerging technology, the science is well ahead of the content of the social discourse and the science is often not well articulated or understood. The scientific community takes time to reach a persuasive consensus on the implications of an emerging technology for societal risks and benefits. During this interval of scientific exploration of impacts of technological innovations, the conventional debates about regulation revolve around applying the precautionary principal to protect against potential risk or regulating only against demonstrated harm. Are there approaches to regulation that allow potential risks to be better imagined and managed without waiting for demonstrated harm or risking stifling innovation.

Duke Law's Center for Innovation Policy, Duke Law's Center on Law & Technology, Duke Science & Society, and the Rethinking Regulation Program at the Kenan Institute of Ethics held a joint conference to explore promising uses of AI and the challenges they pose in administering diverse governmental functions involving science, technology, health and intellectual property.

The summit will highlight the growing opposition to cutting Cost of Living Adjustments (COLAs) for Social Security and disabled veterans. - Under the chained CPI, average 65-year-old retirees would lose $658 a year in Social Security benefits by their 75th birthday, $1,147 by their 85th birthday, and $1,622 by their 95th birthday. - The chained CPI would cut the benefits of more than 3.2 million disabled veterans in this country. Permanently disabled veterans who started receiving disability benefits from the VA at age 30 would see their benefits cut by more than $1,400 a year at age 45, $2,300 a year at age 55 and $3,200 a year at age 65. - The chained CPI also would amount to an across-the-board tax increase on working families. More than three-quarters of the new revenue raised by the year 2021 under the chained CPI would come from Americans making less than $200,000 a year. Those making between $30,000 and $40,000 would be hit the hardest.
